Commercial Terms Summary

Terms & Cover Licensing

Clear, author-friendly commercial licensing standards governing custom book cover commissions, premade covers, and book formatting services operated by brimhouse sp. z o.o.

1. Contracting Entity & Studio Operator

All book cover design, original illustration, premade cover sales, and interior formatting services offered on fadingray.com are created by Lukasz Jaskolski (Fading Ray) and contracted/invoiced commercially through:

brimhouse sp. z o.o.
[Street Address, Postal Code, City], Poland (European Union)
KRS: [0000XXXXXX] • NIP / EU VAT: [PLXXXXXXXXXX]
Contact: contact@fadingray.com

Individual written commission agreements signed with publishing houses or authors take precedence over this general summary where custom buyout or print-run clauses are negotiated.

2. 100% Human-Made Artwork Warranty & Zero-AI Clause

  • Artist Warranty: Fading Ray warrants that all commissioned illustrations, premade covers, and graphic elements are 100% original human creations hand-painted by Lukasz Jaskolski without generative AI image synthesis (no Midjourney, Stable Diffusion, DALL-E, or generative fill).
  • Client Protection Against AI Training: Neither party may upload unfinished sketches or final cover artwork into generative AI training datasets, style-mimicry LoRAs, or AI image-to-image generators without express written permission.

3. Scope of Standard Commercial Book Cover License

Upon receipt of full final payment, the Client (Author or Publisher) is granted an exclusive worldwide commercial book cover license for the designated book title, covering:

  • Digital Ebook editions (Kindle, EPUB, Kobo, Apple Books, direct author store sales);
  • Print editions (Print-on-Demand paperback/hardcover via Amazon KDP, IngramSpark, and offset print runs, subject to any print-cap agreed for large traditional imprints);
  • Audiobook cover adaptation (when included or added to the package);
  • Promotional and marketing graphics directly advertising the book (social media reveals, Amazon/Meta ads, bookmarks, banners, ARC postcards).

Standalone merchandise (e.g., t-shirts, board games, separate art prints sold independently of the book) or film/TV option rights can be licensed separately upon request.

4. Artist Moral Rights, Portfolio Display & Attribution

  • In accordance with international and EU copyright law, underlying authorship and moral rights remain with the illustrator, Lukasz Jaskolski, who retains the right to display the completed cover and textless artwork in studio portfolios, social media, and art annuals (respecting any pre-launch cover reveal embargo dates requested by the Client).
  • The Client agrees to include standard copyright page credit inside the published book: “Cover illustration & design by Lukasz Jaskolski / FadingRay.com” (or “Cover illustration by Lukasz Jaskolski” for Cover Art Only commissions).

5. Premade Book Covers

  • Each Premade Cover is sold strictly once on a first-paid basis and permanently retired from sale upon purchase.
  • Premade purchases are paid 100% upfront due to immediate reservation and fast 48–72 hour typography customization.

6. Custom Commission Payments, Revisions & Scheduling

  • Milestone Split: Custom projects require a 50% booking deposit to lock studio calendar dates and begin concept sketches, with the remaining 50% balance payable upon final low-res approval prior to release of high-resolution print/ebook master files.
  • Revisions: Packages include two structured revision rounds during the sketch/composition phase and minor color/type refinements at the final stage. Major structural changes requested after sketch sign-off (e.g., changing a character’s pose or setting after painting is complete) are billed at an agreed studio day/hour rate.
  • Delayed Page Counts: If final interior page count is not yet finalized at cover completion, final print spine adjustment is honored within 6 months of ebook cover delivery at no extra charge.

7. Governing Law

Agreements concluded with brimhouse sp. z o.o. are governed by the laws of the Republic of Poland and applicable European Union copyright and commercial regulations, without prejudice to mandatory consumer protections where applicable.
